Validity of health certificate

Name: Cristian Dobre

Dear Sirs,

I would much appreciate your views in the following matter.


1. L/C requires among other documents a CMR countersigned by applicant and a health certificate.

2. All documents were presented on 22.09.2008

3. Health certificate shows that is valid until 15.09.2008.

4. The transport document shows that goods were received on 25.08.2008 (stamp and signature of applicant marked on CMR).
My main concern is whether or not the health certificate could be considered compliant having in view following:

-on one hand at the date when applicant received goods (as shown on CMR), the health certificate was valid (25.08.2008 vs 15.09.2008)

-on the other hand at the time of reviewing document by bank the document were no longer valid (15.09.2008 vs 22.09.2008)

Can this document be treated as discrepant? My view is that it cannot.

Based on the information provided I do not see a problem

I do not consider, in this case, the health certificate as being
discrepant.
Would have been discrepant if CMR wasn't countersigned by the applicant.
