Port of loading
Question: Name: Shazad Pervez

We opened an L/C in which 43T: Transhipment was prohibited and 44E: Port of Loading was China. There was no 44A: Place of Receipt.

We received B/L from the beneficiary stating as follows:

1) PORT OF LOADING : HONG KONG

2) PLACE OF RECEIPT: SANBU, CHINA

Now is this a discrepancy or not? That the port of Loading is not China?

It depends..!

See UCP 600 sub-article 20(a)(iii):

If the bill of lading does not indicate the port of loading stated in the credit as the port of loading [...], an on board notation indicating the port of loading as stated in the credit, the date of shipment and the name of the vessel is required. This provision applies even when loading on board or shipment on a named vessel is indicated by pre-printed wording on the bill of lading.

So if the B/L includes an on board notation as prescribed above it would be acceptable.
