Tolerance in LC amount
  Question: Name: MD.Zakir Hossen

MY CONFUSION IS:

L/C is silent about tolerance of the LC amount.

Does the beneficiary have the right to claim more than the credit amount by citing extra supply in the invoice?

Often I find that invoice value is 5% more than L/C amount.

Applicant is ready to accept the documents, but I think that it is some sort of money laundering. If L/C is silent in tolerance of credit amount and the beneficiary submits documents which is more than (say 5% or less) the credit amount then IS IT A DISCREPANCY.

I think it is discrepancy please advise me.

  Answer (from T.O. Lee)

UCP 600 article 30 (b) allows 5% more or less in quantity only (only for quantity described in volume or weight but NOT in packing unit, such as case, box, piece. etc.) whilst the amount cannot be exceeded unless the credit says otherwise.

With this clear statement you should be able to determine compliance of presentations under credits.
