Two vessels on a charter party B/L

Dear sirs,

Not long ago, I saw a set of charter party B/L, which indicated two vessels name in the column "ocean vessel". Beneficiary (shipper) informs us that there are two voyages combined in one set B/L. Since it is on-board B/L, it contains no on-board notation at all. Its contents are complied with L/C requirements.

Q.1 Does the charter party B/L require on-board notations?

Q.2 If the L/C is usance and two notations are added, can ISBP 43e be applicable for determining the maturity date?

Q.3. Is there any discrepancy if partial shipment allowed?

Q.1:

UCP 600 sub-article 22(a)(ii) reads:

… indicate that the goods have been shipped on board a named vessel at the port of loading stated in the credit …

So – Yes it does require an onboard notation on a named vessel at the LC port.

Q.2:

There can be two. Note however it depends highly on the requirements in the LC. If for example the LC says shipment from Singapore – and the CPBL shows on board notations at both Bangkok and Singapore – then the one from Singapore will work as “date of shipment” for the purpose of calculating maturity date.

If on the other hand the LC says shipment from European port and there are on-board notations in Felixstowe and Rotterdam – then the earliest will be the basis for the calculation of the maturity date.

Q.3:

Under normal circumstances that would be transhipment – and not partial shipment.

If however it is as you say (which I have never seen) that one CPBL covers two separate voyages; i.e. two different vessels – and two consignments – and both relate to the same LC then I would expect that such would be partial shipment.
