Your comments on the following question are highly appreciated:

Paragraph 43e ISBP says in the event a b/l showing more than one on board notation is presented under a credit which requires time drafts to be drawn, the earliest of the on board dates will be used for calculation of the maturity date.

Paragraph 80 or 105 ISBP says in the event more than one set of transport documents or b/l are presented and if they incorporate different shipment dates, the latest date of these shipment dates will be taken for calculation of any presentation period .

My question:

If a b/l showing more than one on board notation is presented, which date will be used for calculation of the presentation period, the earliest or the latest of the on board dates?

I see what you are getting at – note however that 43e and 80/105 serves two rather different purposes.

The answer depends highly on the requirements in the LC. If for example the LC says shipment from Singapore – and the bill of lading shows on board notations at both Bangkok and Singapore – then the one from Singapore will work as “date of shipment” for the purpose of calculating maturity date.

If on the other hand the LC says shipment from European port and there are on-board notations in Felixstowe and Rotterdam – then the latest will be the basis for the calculation of the presentation period (e.g. ISBP para 105)
