Copy versus photocopy
  Question:

Name: Syed Murtuza Razvi

I shall be glad if you clarify me the difference between photocopies and copies of a document. In practice, I came across a case where the LC requires Commercial Invoices in One original and two copies. The beneficiaries have presented the commercial invoice in one original and two photocopies of the original to comply with the requirements.

Upon receipt of the documents at the issuing bank counters, the issuing bank refused the documents stating that invoice presented in one original and two photocopies instead of two copies.

Do you think the issuing bank has raised a valid discrepancy? I will be pleased to know your opinion on this issue.

Thanks and regards

  Answer (from Kim Christensen)

Dear Syed Murtuza Razvi,

Interesting. There may be a technical difference between a copy and a photocopy - but for the purpose of the UCP there is not; a copy is a copy is a copy :-)

I do not think that issuing bank is correct.

Best regards

Kim Christensen
